Agreement to Terms

By downloading, installing, or using CarScope, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app. CarScope ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Your continued use of CarScope after changes constitutes acceptance of the new Terms.

1. License Grant

We grant you a limited, non-exclusive, non-transferable license to use CarScope on your Android device for personal use only. You may not:

  • Reverse engineer, decompile, or disassemble the app
  • Copy, modify, or create derivative works
  • Rent, lease, lend, or sell the app
  • Remove or alter any proprietary notices or labels
  • Use the app for commercial purposes (e.g., offering paid scanning services)

2. Subscription Terms

Free Trial

Upon first download, you receive 24 hours of full access to all features, including Pro features. No credit card is required. After 24 hours, the free trial expires and a paid subscription plan is required to continue using Pro features.

Paid Subscriptions

  • Billing: Subscriptions renew automatically every year. You will be charged immediately upon purchase and on each renewal date.
  • Cancellation: You can cancel anytime via CarScope's Account settings. Cancellation is effective at your next renewal date; you retain access until then.
  • Refunds: Within 14 days of purchase, you can request a refund. If your adapter won't connect, we'll refund you, no questions asked. Refunds requested after 14 days are at our discretion.
  • Price changes: We may change subscription prices upon 30 days' notice. Price increases apply only at your next renewal.

3. Acceptable Use

You agree not to use CarScope for any unlawful or prohibited purpose, including:

  • Hacking, tampering with, or damaging vehicles you don't own or have permission to scan
  • Using CarScope to facilitate fraud or illegal activity
  • Attempting to bypass, disable, or circumvent app security or licensing mechanisms
  • Using the app to support discrimination, harassment, or abuse
  • Overloading our servers or attempting denial-of-service attacks

4. Diagnostic Disclaimer

IMPORTANT: CarScope reads and displays OBD2 diagnostic data for informational purposes only. We make no warranties about the accuracy, completeness, or suitability of this information for any specific purpose.

  • Not a replacement for professional diagnosis: A trouble code is not a diagnosis. The same code can indicate different problems on different vehicles. Always consult a qualified mechanic before making repair decisions.
  • Safety-critical issues: If you see codes related to brakes, airbags, steering, or emissions (if emissions control is safety-critical in your region), stop using the vehicle and consult a professional immediately.
  • Code clearing: Clearing a trouble code does not repair the underlying problem. The code will return if the issue persists. Use code clearing only after confirming the problem is fixed.
  • System limitations: Some vehicles or after-market modifications may not support all OBD2 parameters. CarScope may show incomplete or incorrect data in these cases.

5. Vehicle Compatibility

CarScope works with 1996+ vehicles equipped with OBD2 ports. However, compatibility is not guaranteed for:

  • Certain hybrid or electric powertrains
  • Vehicles with non-standard OBD2 implementations
  • Heavy equipment or commercial vehicles using proprietary protocols

We provide no warranty that CarScope will work on your specific vehicle. The free trial allows you to test compatibility before purchasing a subscription.

6. Hardware Requirements

CarScope requires:

  • Android 7 or later
  • Bluetooth capability
  • A compatible ELM327 OBD2 Bluetooth adapter (not included)

CarScope is not responsible for adapter quality, reliability, or failure. If your adapter fails, purchase a replacement from a third-party vendor.

7. Limitation of Liability

To the maximum extent permitted by law, CarScope is provided "as-is" without warranties of any kind, express or implied. We disclaim all warranties including:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Uninterrupted or error-free operation

In no event shall we be liable for:

  • Direct, indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or use
  • Damage to your vehicle resulting from incorrect diagnostics or code clearing
  • Third-party claims or disputes

Our total liability is limited to the amount you paid for your subscription in the past 12 months.

8. Indemnification

You agree to indemnify, defend, and hold harmless CarScope from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of CarScope
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Damage to your vehicle or someone else's vehicle resulting from your use of CarScope

9. Intellectual Property

All content, features, and functionality of CarScope (including software, text, images, logos) are owned by CarScope or licensed to us. You may not reproduce, distribute, or transmit this content without permission.

10. Privacy

Your use of CarScope is governed by our Privacy Policy. Please review the Privacy Policy to understand our practices.

11. Termination

We may terminate your license or account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Reverse engineer or attempt to circumvent licensing
  • Harass our support team or other users

Upon termination, your right to use CarScope ends immediately, though you retain any purchased subscription until its renewal date if termination is not due to your breach.

12. Third-Party Services

Stripe

We use Stripe to process payments. Your use of Stripe is governed by Stripe's terms. We are not responsible for Stripe's service or policies.

NHTSA API

The VIN lookup feature uses the NHTSA API to retrieve recall data. Use of NHTSA's service is governed by their terms. CarScope is not responsible for the accuracy or availability of NHTSA's data.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States. Any legal action or dispute shall be resolved in the state where the Company is located. If you are outside the US, you consent to the exclusive jurisdiction of US courts.

14. Dispute Resolution

Before pursuing any legal action, we encourage you to contact us at hello@getcarscope.com to attempt resolution. If we cannot resolve your dispute informally, you may pursue legal action as described in Section 13.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision is severed and the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and CarScope regarding your use of the app. No other representations, agreements, or promises are valid unless made in writing and signed by both parties.
